When California Fish & Wildlife Game Wardens Break The LAW….
What happens to a game warden when they have broken the law? Absolutely nothing! UNLESS…. you take it upon yourself to take action. Like all law enforcement in the state of California, CDF&W are of no exception and are legally required to obey all laws when not responding to a immediate emergency. The same as the public is. Including traffic laws. Which we will be covering in this blog. I’m sure everyone at some point has seen law enforcement personnel speed, run a traffic signal, illegally park their patrol vehicle and so on. While in non-emergency capacity. Meaning no lights on and not responding to emergency. I’m sure most people when witnessing these types of situations get a feeling of unfairness. Watching law enforcement personnel abusing their power and paying no mind to laws that pertain to them as well as the public. Hence the reasoning for making this kind of conduct illegal for law enforcement as well as the public. In this blog post you will read a report I have written concerning public safety issues. Which were brought on by Tehema County game wardens Mitch Carlson and Jeremy Benisio as they break several traffic laws and put motorist at a high risk of injury or worse. While on duty but not operating in emergency capacity. Likely due to laziness. As it is easier for the pair of wardens to pull onto the shoulder of the oncoming traffic lane (partially blocking the lane). Then it is to park on the correct and safe side of the road and walking to their favorite look out on foot. Only a matter of a few yards away. A selfish decision leaving innocent motorist at risk of having to cross double yellow lines into the oncoming traffic lane. Do you feel like these Tehema County game wardens should be held to the same accountability for their misconduct as any other member of society would be? Have to love (CDFW) wardens Jeremy Besneezio and Mitch Carlson. As they both abuse their authority on a daily basis. Both parking their patrol vehicles in “non” emergency capacity. Essentially where ever they want. In this instance as shown in the video. Warden Jeremy Benisio parks on a narrow divided roadway. Facing oncoming traffic, and in fact parked partially in the oncoming traffic lane. Causing a unarguable traffic hazard to innocent motorist traveling North down Gardner Ferry Rd in Corning, Ca. A road hundreds of vehicles travel every day. Why? To allow warden Benisio to have the view of the Woodson Bridge boat launch area from across the river. Right out his driver side window. To lazy to park down the road and walk to the location. The game warden would selfishly rather cause a traffic hazard then walk less then a hundred yards to obtain the same view. Without putting the public at risk of unnecessary traffic hazards. Parking on the opposite side of the road where it is safe, and crossing the road on foot to observe the boat launch area, would be in my opinion, much more safe, and much more practical for viewing the Woodson Bridge Boat Launch area undetected. As apposed to parking his patrol vehicle in mostly plain sight. As i detected his patrol vehicle in the three incidents documented here. This is a common occurrence by warden Benisio and has been noted and deemed a public safety hazard by many locals to the area. This video attached was shot at Woodson Bridge on September 29, 2020.
Here I demonstrate exactly where wardens Jeremy Benisio and Mitch Carlson park their patrol vehicle in “non” emergency capacity (meaning no lights on and not responding to any active emergencies). Allowing them to be parked in such a dangerous position for oncoming traffic. Just so they can watch the ongoings of bystndards recreating at Woodson Bridge in Corning, Ca. This is also where the warden was filmed parked in his patrol vehicle in both videos and the single photograph. Occurring on September 29, 2020, January 25, 2020 and again on October 18, 2020. Multiple and direct violations of CVC section 21055.

I guess for me it comes down to accountability. Why would it be ok for a game warden to violate a traffic law when it wasn’t necessary to do so. For their own benefit? Because they are lazy? Because they can! They know the likelihood of someone calling them in on it, is almost non existent. In reality it isn’t a huge deal. But the fact remains these actions are against the law, and there are reasons for these laws to exist. Primarily revolving around the public’s safety on roadways, and while in their vehicle. This is beside the fact it sets a terrible example for new drivers, future game wardens, and passerby’s.
Despite drawing negative attention to myself by holding CDF&W accountable for these couple slap-dick, bad apples, and their bad behaviors. I feel it is just as important to point out that their are exemplary staff employed by the same department. The fact that I pointed out the poor conduct of the two mention employees in this blog. Filing citizen report forms with their department and the Department Of The Interior! For their accountably in breaking the law. It would be only fair to take the opportunity to point out the over achieving employees at the CDF&W. Believe me when I say it brings more enjoyment to give a positive citizen report for Department staffers then it does to turn in a negative report. Let me mention quickly, that a citizens report form from the CDF&W also is excepting of citizens reports for exemplary conduct while performing their duties. Or for going above and beyond the scope of their job requirements. I have filed two such positive reports out, along with the negative ones filed on the wardens mentioned above. Cheers! Tight lines!
